General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Stock&Sew to consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.

2. Contractual Partner

The purchase contract is concluded with PosterLane, Owner:Lukas Biehler, Gansackerstraße 10, 77975 Ringsheim.

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

3.2. By clicking the [Buy/Order with obligation to pay] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places the order for purposes that cannot be attributed to your commercial or independent professional activity), you are entitled to a statutory right of withdrawal.

4.2. If you exercise your right of withdrawal according to clause 4.1 as a consumer, you must bear the regular costs of returning the goods.

4.3. Furthermore, the following withdrawal policy applies to the right of withdrawal in detail:

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us, Stock&Sew, Lukas Biehler, Gansackerstraße 10, 77975 Ringsheim., Email: info@stockandsew.com, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory. You can also electronically complete and submit the model withdrawal form or any other clear statement on our website (insert internet address). If you use this option, we will promptly (e.g., by email) send you confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive the communication about your withdrawal from this contract. We will use the same means of payment for the reimbursement as you used for the initial transaction unless expressly agreed otherwise with you; in any case, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back the goods or hand them over to us or (if applicable, insert the name and address of the person authorized by you to receive the goods) without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Right of Withdrawal for Digital Products

If you purchased a digital product such as software, an app, an e-book, or a music file online, you can withdraw your order free of charge within 14 days across the EU. However, this right of withdrawal for digital products ceases to exist once the following conditions are met:

  • You have begun the download or streaming of the product, and

  • You have explicitly agreed that the seller may begin with the execution of the contract before the end of the withdrawal period, and

  • You have acknowledged that you lose your right of withdrawal by consenting to the start of the download.

5. Prices and Shipping Costs

The prices listed on the product pages include statutory VAT and other price components.

6. Delivery

7. Payment

7.1. Payment can be made by credit/debit card or PayPal.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Warranty for Defects

Stock&Sew is liable for defects in accordance with the applicable statutory provisions, particularly §§ 434 ff of the German Civil Code (BGB).

10. Dispute Resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations arising from online purchase agreements. We are neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.
